Guidance for landlords - Tenant Screening Tips    
 

It is important for Landlords to develop an application procedure and follow those procedures for all prospective tenants, subsidized or not. If a landlord does not treat each applicant the same, they could be in violation of the Fair Housing Laws. It has been approved that a landlord may accept one Voucher family and will not be required to accept any more. * When you are contacted by a prospective renter, evaluate them as you would any other renter.

* Make sure that your tenant selection standards are based on objective, business-related considerations, such as previous history of non-payment, damages to unit, or disturbance of neighbors. Owners must apply the same standards of tenant selection to any family who applies, whether that family is a prospective Housing Voucher renter or not. Tenant selection must not be based upon race, color, age, religion, sex, familial status, disabilities or any other discriminatory factors.

* The Kendall Housing Authority does not screen families for their suitability as renters, that is the job of the owner.

* The Kendall Housing Authority may, at the owners request, disclose the following:

    o Current and previous landlord name and address

    o Previous damage claims filed by landlords (Contracts prior to 10/2/1995 allowed for damage claims)

    o Any known evictions on file (not a comprehensive list)

* Kendall County Courthouse allows the public to run criminal and civil background checks on any individual for free. This database only covers Kendall County

How to Lease a Voucher Holder    
Steps for Owners who are Interested in the Program

1.  Finding a tenant
A prospective tenant may come to you with a Voucher in hand or you may list your available unit with K.H.A. The landlord does not have to be pre-approved.

2.  Owner Approves tenant
Even though a family is determined eligible for the program by the K.H.A., the owner must approve the family as a suitable renter by screening the family as they would any other family.  

3.  Moving Packet


The tenant will supply a moving packet for the landlord to fill out with the tenant. 

The owner submits the completed moving packet and a copy of his/her standard unexecuted lease to the KHA.  Once the housing authority staff approves the tenancy the landlord will be contacted and a Housing Quality Standards Inspection scheduled.  The inspection is scheduled between 1 and 10 business days from the date the moving packet is received, assuming the unit is ready for inspection. 

Once the lease is approved, the unit passes inspection, the KHA will advise the landlord of the date the tenant may begin the lease. 

The security deposit is the responsibility of the tenant as the housing authority does not assist with security deposits.  The landlord should handle collection of the security deposit and the tenant first month rent portion the same as he/she would for all tenants whether assisted or unassisted. 

The owner will enter into a Housing Assistance Payments (HAP) contract with the KHA and sign a lease agreement with the family.   

The KHA will mail the first HAP payment to the landlord the first of the month following the housing authority receipt of executed lease and HAP contract.
